Creditors' Rights & Bankruptcy

Financially-distressed debtors present unique and complex problems and opportunities. The members of our Creditors' Rights and Bankruptcy Practice Group are experienced in guiding clients through creditor/debtor disputes, and in helping them achieve their goals timely and efficiently. Our practice focuses primarily on the needs of creditors, and our lawyers have represented both institutional and individual creditors in matters ranging from personal bankruptcies to corporate reorganizations on a national scale. Members of our practice group have represented clients throughout Indiana and in many other states in creditor/debtor litigation and bankruptcy cases.

The Creditors' Rights and Bankruptcy Practice Group is composed of veteran lawyers who have counseled clients on the many issues that arise when businesses or individuals are in financial distress, including the following: structuring investments in emerging companies and high-risk business ventures; loan workouts; collection and foreclosure actions; purchasing and selling assets of failing companies; recovery of collateral for secured creditors; and negotiation, litigation and documentation in bankruptcy cases of plans of reorganization, proofs of claim, adequate protection and cash collateral issues, preference and fraudulent conveyance claims, post-petition financing disputes, and disputes regarding leases, contracts and the dischargeability of debts. Practice group members are frequent lecturers at continuing legal education seminars, and participate in bankruptcy and creditors' rights committees of local, state and national bar associations.

A graduate of Purdue University and Indiana University School of Law, where he was the editor-in-chief of the Indiana Law Review (1980-81), Mr. Wenzel concentrates his practice in the areas of creditors' rights, bankruptcy, real estate and commercial law. He is a member of the firm's Creditors' Rights and Bankruptcy Practice Group, and is also a member of its Litigation and Business Practice Groups. Mr. Wenzel has represented creditors, debtors and investors in creditor/debtor litigation and in bankruptcy cases throughout the United States . He is admitted to practice in Indiana state and federal courts, and the United States Court of Appeals for the Seventh Circuit.
